Terms of service

Last updated 28 September 2026

Overview

Welcome to Textures By Dani. The terms “we”, “us” and “our” refer to Textures By Dani. We operate this store and website, including all related information, content, features, tools, products and services (the “Services”). Textures By Dani is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referred to in them (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services. Please read them carefully, as they include important information about your legal rights.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you should not use or access our Services.

1. Access and account

By agreeing to these Terms of Service, you confirm that you are at least 18 years of age, or the age of majority in your state or territory of residence, and that you consent to any minor dependants in your care using the Services on devices you own or manage.

To use the Services, including browsing our store or purchasing a course, you may be asked to provide information such as your email address and payment details. You confirm that the information you provide is correct, current and complete, and that you have all rights necessary to provide it.

You are solely responsible for maintaining the security of your account credentials and for all activity on your account. You may not transfer, sell, assign or license your account to any other person.

2. Our courses

We have made every effort to represent our courses and their content accurately. Colours and appearance may differ from how they appear on your screen depending on your device and its settings.

We do not warrant that the appearance or quality of any course will meet your personal expectations, beyond the guarantees that apply under the Australian Consumer Law.

Course descriptions and content may be updated or modified from time to time to improve or maintain the quality of our courses. We may discontinue a course where reasonably necessary. If we permanently discontinue a course, we will endeavour to provide reasonable notice where practicable and, where appropriate, offer existing customers an alternative arrangement.

3. Orders

When you place an order you are making an offer to purchase. We may accept or decline your order at our discretion. Your order is not accepted until we confirm acceptance, and we must receive and process your payment before your order is accepted. Please review your order carefully before submitting it, as we may be unable to accommodate cancellation requests once an order is accepted.

If we do not accept, change or cancel an order, we will attempt to notify you using the email address, billing address or phone number provided at the time of the order.

Your purchases are subject to our Refund Policy. Courses are purchased for your own personal learning and not for commercial resale or redistribution of the course itself. This does not limit what you may do with the artwork you create — see section 8.

4. Prices and billing

Prices are in Australian dollars and include GST where applicable. Prices, discounts and promotions may change without notice. The price charged will be the price in effect when the order is placed and will be set out in your order confirmation email.

From time to time we may offer promotions governed by their own terms. If there is a conflict between the terms of a promotion and these Terms, the promotion terms apply.

You agree to provide current, complete and accurate purchase, payment and account information, and to keep it up to date so we can complete your transactions and contact you as needed. You confirm that the payment details you provide are true and correct, that you are authorised to use the payment method, and that you will pay the charges incurred at the posted prices, including any applicable taxes.

5. Delivery

Our courses are delivered digitally. Access details are emailed to the address provided at checkout, immediately after payment is confirmed. If you have not received access within a few minutes, please check your junk folder and then contact us.

We aim to keep courses available at all times, but we do not guarantee uninterrupted availability of hosting or video platforms outside our control.

If you experience a problem accessing a course after purchase, please contact us using the details in section 27. We will take reasonable steps to assist you and restore access where the issue is caused by an error within our reasonable control.

6. In-person workshops

In-person workshops are booked and paid through ClassBento. Bookings, cancellations and refunds for those workshops are governed by ClassBento’s terms rather than these Terms.

7. Your licence to use the course

When you buy a course, you receive a personal, non-exclusive, non-transferable licence to view the course content for your own learning. You do not buy the content itself. You must not:

  • share, forward, post or publish your course link or login with anyone else
  • download, record, screen-capture or copy the course videos or materials
  • resell, sublicense, distribute or give away access to the course
  • use the course content to teach, run workshops, or create your own course or tutorials
  • use the content to train an artificial intelligence model

Lifetime access means ongoing access to the purchased course for as long as the course continues to be offered and supported by Textures By Dani. There is no fixed expiry date or recurring subscription fee.

If we permanently discontinue a course, we will endeavour to provide reasonable notice where practicable and, where appropriate, offer existing customers an alternative arrangement.

We may suspend or terminate your access to a course without refund where you materially or intentionally breach these licence restrictions, including by sharing, copying, recording, distributing or commercially exploiting course content without our permission.

8. Intellectual property and your artwork

Our Services, including all trade marks, text, displays, images, graphics, video and audio, and the design, selection and arrangement of them, are owned by Textures By Dani or its licensors and are protected by Australian and international copyright and intellectual property laws.

The artwork you create is yours. You are welcome to sell pieces you make using the techniques taught. Techniques themselves are not owned by anyone. What you may not do is reproduce our course materials, or use them to run your own classes, tutorials or courses.

Except as expressly set out in these Terms, nothing grants you a licence or other rights under any trade mark, copyright or other intellectual property of Textures By Dani, Shopify or any third party. The Textures By Dani name, logo and designs are our trade marks and may not be used without our prior written permission. Shopify’s name, logo and product names are trade marks of Shopify. All other names and marks on the Services belong to their respective owners.

9. Safety

Textured art uses plasters, compounds, adhesives, paints and hand tools. Follow the manufacturer’s safety instructions for every product you use, work in a well-ventilated space, wear appropriate protection, and keep materials away from children and pets.

Our courses are for general instruction. Subject to section 14, we are not responsible for injury, or damage to property or surfaces, arising from how you apply the techniques. Results vary with your materials, surfaces and practice, and we do not guarantee any particular artistic or commercial outcome.

10. Refunds

Refunds are governed by our Refund Policy, which forms part of these Terms.

Because our courses are digital products and access is provided immediately after purchase, we do not offer refunds for change of mind once course access has been provided.

This does not exclude, restrict or modify any rights or remedies you may have under the Australian Consumer Law. Where a course does not meet a consumer guarantee that cannot lawfully be excluded, you may be entitled to a remedy in accordance with the Australian Consumer Law.

11. Optional tools and third-party links

You may be given access to tools offered by third parties, which we neither monitor nor control. We provide access to such tools on an “as is” basis without endorsement, and your use of them is at your own risk. You should make sure you are familiar with and approve of the terms on which those tools are provided.

The Services may contain links to websites operated by third parties. We are not responsible for examining or evaluating their content or accuracy, and we are not liable for your dealings with them. Please review the policies of any third party before transacting with them, and direct any complaints about their products or services to them.

We may offer new features and tools in future. Those will also form part of the Services and be subject to these Terms.

12. Relationship with Shopify

Textures By Dani is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Textures By Dani. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Textures By Dani, including any injury, damage or loss resulting from purchased products and services. You expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with Textures By Dani.

13. Privacy

All personal information we collect through the Services is subject to our Privacy Policy, and certain personal information may also be subject to Shopify’s Privacy Policy. By using the Services you acknowledge that you have read those policies.

Because the Services are hosted by Shopify, Shopify collects and processes information about your access to and use of the Services in order to provide and improve them. Information you submit may be transmitted to and shared with Shopify and other third parties that may be located outside Australia, in order to provide those services to you.

14. Your rights under the Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law.

For major failures with the service, you are entitled:

  • to cancel your service contract with us; and
  • to a refund for the unused portion, or to compensation for its reduced value.

You are also entitled to be compensated for any other reasonably foreseeable loss or damage.

If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion.

Nothing in these Terms excludes, restricts or modifies any right, guarantee, remedy or protection available to you under the Australian Consumer Law to the extent that it cannot lawfully be excluded, restricted or modified.

15. Disclaimer of warranties

Information presented on or through the Services is made available for general information purposes only. We do not warrant its accuracy, completeness or usefulness, and any reliance you place on it is at your own risk.

Subject to section 14, and except as expressly stated by us, the Services and all products offered through them are provided on an “as is” and “as available” basis without representations, warranties or conditions of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title and non-infringement. We do not guarantee that your use of the Services will be uninterrupted, timely, secure or error-free.

16. Limitation of liability

Subject to section 14, and to the fullest extent permitted by law, Textures By Dani, our partners, employees, affiliates, agents, contractors, service providers and licensors are not liable for loss or damage arising from your use of the Services where that loss or damage results from your misuse of the Services, your failure to follow instructions or safety guidance, or circumstances beyond our reasonable control.

Nothing in these Terms excludes, restricts or modifies any liability that cannot lawfully be excluded, restricted or modified.

Where our liability can lawfully be limited, our liability will be limited to the remedies permitted by applicable law, including resupplying the relevant course or refunding the price paid for it, as appropriate.

17. Feedback

If you submit ideas, suggestions, feedback, reviews or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute and display that Feedback in any medium for any purpose, including commercial use, such as operating, improving and promoting the Services.

You confirm that you own or have all necessary rights to your Feedback, that you have disclosed any compensation or incentive received in connection with it, and that it complies with these Terms. We are under no obligation to keep Feedback confidential, to pay for it, or to respond to it.

Your Feedback must not infringe any third party’s rights, including copyright, trade mark, privacy or personality rights, and must not be unlawful, defamatory, abusive, obscene or contain malicious code. You may not use a false email address or impersonate another person. You are solely responsible for the Feedback you submit, and we may edit or remove Feedback we consider objectionable or in breach of these Terms.

18. Errors, inaccuracies and omissions

Occasionally there may be information in the Services containing typographical errors, inaccuracies or omissions relating to course descriptions, pricing, promotions, offers or availability. We reserve the right to correct any errors, and to change or update information or cancel orders if any information is inaccurate, at any time and without prior notice, including after you have submitted your order.

19. Prohibited uses

You may access and use the Services for lawful purposes only. You may not use the Services, directly or indirectly: for any unlawful or malicious purpose; to breach any applicable Australian or international laws or regulations; to infringe our intellectual property rights or those of others; to harass, abuse, defame, intimidate or harm any person; to transmit false or misleading information; to send advertising or promotional material such as junk mail or spam; to impersonate any other person or entity; or to engage in conduct that restricts anyone’s use of the Services or may expose us, Shopify or other users to liability.

You also agree not to upload viruses or malicious code; reproduce, duplicate, copy, extract, sell or resell any portion of the Services; collect or track the personal information of others; spam, phish or pharm the Services; use any robot, spider, scraper, data-extraction tool, AI agent or automated process to access the Services; or interfere with, bypass or circumvent our security or access-control measures. We may suspend, disable or terminate your account at any time, without notice, if we determine that you have breached these Terms.

20. Agents

This section applies if you use, allow, enable or cause the deployment of an Agent to access or interact with the Services. “Agent” means software or a service that takes autonomous or semi-autonomous action on behalf of a person or entity without direct supervision.

No Agent may access or interact with the Services unless it identifies itself and operates in accordance with this section at all times, and no Agent may do so if we have asked it to refrain. We may limit, including by technical measures, whether and how any Agent accesses the Services.

Agents must identify themselves in all HTTP and HTTPS requests by including “Agent/[agent name]” in the user agent string; must not conceal that access is from an Agent, including by mimicking human interaction patterns or circumventing measures intended to distinguish computers from humans; must answer truthfully any prompt seeking to determine whether interactions come from a human; and must not circumvent any measure intended to block, limit or control Agent access.

21. Indemnity

You agree to indemnify and hold harmless Textures By Dani, our affiliates, partners, officers, employees, agents, contractors, licensors and service providers from losses, damages, liabilities or claims, including reasonable legal costs, arising from your material breach of these Terms, your unlawful use of the Services, or your infringement of the rights of a third party.

We will notify you of any claim for which we seek indemnification and will take reasonable steps to mitigate any loss. We may participate in the defence or settlement of such a claim where appropriate.

This indemnity does not apply to the extent that the relevant loss or liability was caused by our negligence, breach of these Terms or conduct that cannot lawfully be excluded or limited.

22. Termination

We may suspend or terminate your access to the Services where you materially breach these Terms, engage in unlawful or fraudulent conduct, misuse or distribute course content without permission, or otherwise use the Services in a manner that may cause harm to Textures By Dani, our customers or our service providers.

Where reasonably practicable, we will provide notice and an opportunity to remedy the breach before terminating access, except where immediate suspension or termination is reasonably necessary for security, legal or other legitimate reasons.

Termination does not affect any rights or remedies that you have under the Australian Consumer Law.

The following sections continue to apply after termination: Your licence to use the course, Intellectual property and your artwork, Feedback, Your rights under the Australian Consumer Law, Disclaimer of warranties, Limitation of liability, Indemnity, Severability, Waiver and entire agreement, Assignment, Governing law and Privacy, along with any other provisions that by their nature should survive.

23. Severability, waiver and entire agreement

If any provision of these Terms is found to be unlawful, void or unenforceable, it will be enforceable to the fullest extent permitted by law and the unenforceable portion severed, without affecting the validity of the remaining provisions.

Our failure to exercise or enforce any right or provision of these Terms is not a waiver of that right or provision.

These Terms, together with any policies posted on this site, constitute the entire agreement between you and us and govern your use of the Services, superseding any prior agreements or proposals, whether oral or written, including any earlier versions of these Terms.

24. Assignment

You may not delegate, transfer or assign these Terms or any of your rights or obligations under them without our prior written consent, and any attempt to do so is void. We may transfer, assign or delegate these Terms and our rights and obligations without your consent.

25. Governing law

These Terms of Service and any separate agreements by which we provide you Services are governed by the laws of Victoria, Australia. You and Textures By Dani submit to the non-exclusive jurisdiction of the courts of Victoria.

26. Changes to these Terms

You can review the current version of these Terms at any time on this page. We may update, change or replace these Terms from time to time by posting an updated version to our website.

Changes will apply from the date they are published and will generally apply to future purchases and use of the Services. Unless required by law, changes will not retrospectively alter the rights or obligations applicable to purchases made before the changes took effect.

We will notify you of material changes where required by applicable law.

Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms to the extent permitted by law.
